NJ MARINE SPARED JAIL TIME OVER 30 RD MAGS!
CHRISTMAS CAME EARLY FOR MIKE & DANI HARKY!

by Black Wire Media Tues. Dec. 24, 2019 www.cnjfo.com

December 13th will forever be considered a "holiday" worth celebrating in the Harky household. The Waldwick, NJ businessman and Marine combat-disabled Vet that was blown-up in an IED explosion in the sandbox was never charged by the Bergen County Prosecutor for the (2) "Hi-Cap", NJ-contraband 30 round (STANDARD CAPACITY) mags found in his Marine footlocker as the result of an unfounded TRO (temporary restraining order) Police raid of his home in February. You'll recall that NO firearm or AMMO for those Marine-issued mags were ever found. We had reported that an arrest was made when the mags were found; the arrest was for not submitting to the search "politely", and has since been adjudicated (THROWN-OUT). Harky was quite upset during our exclusive telephone interview in October which lasted 1.5 hours, and even though he proofread it for accuracy prior to us going live, the minutia was a bit "fuzzy".

"I apologize for the misunderstanding of being charged, as I thought I was when the lawyer forwarded over the letter from the Prosecutor (witness list containing names of PD Sgt at raid & expert for mags---Ed). I was wrong, however the Prosecutor sure as shit was trying like all hell to take my gun rights AWAY and did try to charge me during the court proceeding on Friday." ---Mike Harky

The forfeiture hearing of December 13th was quite interesting, as noted firearms attorney Evan Nappen was able to get the two 30-round mags thrown-out due to the procedure utilized by the state's expert witness being scrutinized. With the mags "gone", no further roadblock was in Harky's way and Bergen County Judge James Guida, holding a copy of Harky's Facebook story in his hands, did issue a ruling that Harky's gun rights BE COMPLETELY RESTORED! Monday December 16th Harky and his new wife Dani received word from Nappen that ALL of his gun rights HAVE BEEN RESTORED! Harky made an appointment and retrieved his modest knife collection last Thursday (Dec. 19th), so THE DRAMA IS OVER for Dani & Mike!

EDITOR's NOTE:

Harky was re-interviewed last Thursday, and we attempted to reach his attorney Evan Nappen via email, for a comment. No email was returned, but since our readers deserve to know how this delightful outcome came to be, we held it until now and are sharing it with you as our official CHRISTMAS STORY!
